The Employment Standards Act (ESA) applies to workers.
An employee consists of a person who:
– performs work for an employer for wages
– materials services to a company for salaries
– gets training from an employer, if the ability in which the individual is being trained is an ability used by the employer’s staff members
– is a homeworker
– was an employee
Effective March 21, 2024, a worker includes a person who carries out work during a trial period for an employer, if the abilities being assessed during the trial period are abilities used by the employer’s workers or might be utilized by staff members if there are no other workers. For instance, where an employer of a restaurant asks a job candidate to work a trial shift waiting tables to show their capability to perform the task, even where no employment deal has been made to that prospect, the person is an employee under the ESA.
The ESA does not apply to independent contractors, volunteers or other people who are not covered under the ESA. An individual considered a staff member might be entitled to rights such as:

How to inform who is an independent contractor
